This Privacy Policy describes how Palettio ("we," "us," or "our") collects, uses, and shares information when you use the Palettio mobile application (the "App"), available on Apple App Store and Google Play Store. We are committed to protecting your privacy and being transparent about our practices.

1. Information We Collect

1.1 Data You Create

All colors, palettes, gradients, and preferences you create in the App are stored locally on your device using on-device storage (AsyncStorage). This data is never transmitted to our servers. We do not have access to it.

1.2 Data Collected Automatically by Third-Party Services

The App integrates the following third-party services, each of which may collect data as described below:

1.3 Camera and Photo Library

The App requests access to your camera and photo library solely for color extraction. Photos are processed entirely on your device. We do not upload, store, transmit, or have any access to your images. Camera data is never shared with any third party.

1.4 Data We Do NOT Collect

We do not collect your name, email address, phone number, or any personal contact information through the App
We do not require account creation or login
We do not collect precise location data (GPS coordinates)
We do not access your contacts, calendar, microphone, or any other device sensor beyond the camera
We do not use fingerprinting or cross-app tracking technologies

2. How We Use Information

App functionality: To provide color capture, palette creation, accessibility testing, and export features
Advertising: To display ads via Google AdMob in the free version (Pro subscribers see no ads)
Subscriptions: To verify and manage Pro subscription status via RevenueCat
Stability: To monitor crashes and fix bugs that affect user experience
Legal compliance: To comply with applicable laws, regulations, and legal processes

3. Advertising and Tracking

3.1 Google AdMob

The free version of Palettio displays interstitial advertisements provided by Google AdMob. Ads appear at natural break points in the user experience (after completing actions like saving or exporting), not during active use.

AdMob may use your Advertising Identifier and device information to serve personalized advertisements. You can control this:

iOS 14.5+: The App uses Apple's App Tracking Transparency (ATT) framework and will explicitly ask your permission before any tracking. If you decline, only contextual (non-personalized) ads are shown.
Android: Go to Settings > Privacy > Ads > "Delete advertising ID" or "Opt out of Ads Personalization."

Palettio Pro subscribers do not see any advertisements and no ad-related data is collected for them.

3.2 App Tracking Transparency (iOS)

On iOS, we comply with Apple's ATT framework. We present a tracking permission dialog before accessing the IDFA. If you deny tracking, the App continues to function normally with contextual ads. Your choice has no impact on the App's core features.

4. In-App Purchases and Subscriptions

Palettio offers optional "Pro" subscriptions (monthly and annual plans) managed entirely through the Apple App Store and Google Play Store. We use RevenueCat as a subscription management platform. We never have access to your payment method, credit card number, billing address, or Apple/Google account credentials. All payment processing is handled by Apple or Google.

The annual plan may include a free trial period. If you do not cancel before the trial ends, you will be automatically enrolled in the paid subscription.

5. Data Sharing

We do not sell, rent, or trade your personal information. Data may be shared with:

Google (AdMob): Advertising data for serving ads in the free version, subject to Google's Privacy Policy
RevenueCat: Anonymous subscription data, subject to RevenueCat's Privacy Policy
Law enforcement: Only when required by law, court order, or governmental regulation

6. Data Retention and Deletion

All user-created data is stored locally on your device. You can delete it at any time via Settings > Data Management in the App. Uninstalling the App removes all locally stored data permanently.

Third-party services (AdMob, RevenueCat) retain data according to their own policies. You may contact them directly to request deletion of data they hold.

7. Data Security

We implement reasonable security measures appropriate for a mobile application. All color data remains on your device and is not transmitted over the internet. Third-party services use industry-standard encryption for data in transit.

8. Children's Privacy

Palettio is rated 4+ (App Store) and "Everyone" (Google Play). We do not knowingly collect personal information from children under 13 years of age (or the applicable age in your jurisdiction, including 16 under GDPR). The App does not require any personal information to use.

9. Your Rights

European Economic Area (GDPR)

If you are in the EEA, you have the right to: access your personal data; rectify inaccurate data; request erasure; restrict processing; data portability; and object to processing. Since Palettio stores data locally, you exercise most rights directly through the App's Data Management settings.

California (CCPA/CPRA)

California residents have the right to: know what personal information is collected; request deletion; opt out of the sale or sharing of personal information. We do not sell or share personal information as defined by the CCPA/CPRA.

Brazil (LGPD)

Brazilian users have rights regarding access, correction, anonymization, deletion, and portability of personal data under the Lei Geral de Proteção de Dados.

Other Jurisdictions

We respect privacy rights under all applicable laws. If you have specific requests regarding your data, please contact us.

10. International Data Transfers

Third-party services (Google, RevenueCat) may process data in countries outside your country of residence, including the United States. These services use appropriate safeguards (Standard Contractual Clauses, adequacy decisions) for international transfers.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be reflected in the "Last updated" date. Material changes will be communicated through the App or this website. Continued use of the App after changes constitutes acceptance.

These Terms of Service ("Terms") govern your access to and use of the Palettio mobile application (the "App") provided by Palettio ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms in full. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.

2. Description of Service

Palettio is a color picker, palette generator, and design tool available on iOS and Android. Features include color capture from camera/photos, palette and gradient creation, color accessibility tools (WCAG contrast checking, color blindness simulation), color simulation in UI components, and export to 11 professional formats.

3. Free Version and Limitations

The App is free to download and use with the following limitations:

Maximum 25 saved colors
Maximum 10 saved palettes
Maximum 10 saved gradients
Maximum 5 exports per day
Advertisements are displayed during use

These limits may be adjusted at our discretion. Existing data that exceeds any new limit will be preserved but you will not be able to create new items until within the limit, or until you upgrade to Pro.

4. Palettio Pro Subscription

4.1 What Pro Includes

Palettio Pro removes all limitations: unlimited colors, palettes, gradients, and daily exports. All advertisements are removed.

4.2 Plans and Pricing

Monthly: Billed monthly. Cancel anytime.
Annual: Billed annually. Includes a 3-day free trial for eligible users.

Prices are set in the respective stores and may vary by region. Current pricing is displayed in the App before purchase.

4.3 Free Trial

The annual plan may include a 3-day free trial. During the trial, you have full access to all Pro features at no charge. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid annual subscription and your payment method will be charged. Free trial eligibility is determined by Apple or Google and is typically available only to new subscribers.

4.4 Billing and Renewal

Subscriptions are processed exclusively through Apple App Store or Google Play Store
Payment is charged to your App Store or Google Play account upon purchase confirmation (or at the end of any free trial period)
Subscriptions renew automatically unless auto-renewal is disabled at least 24 hours before the current period ends
Renewal is charged within 24 hours prior to the end of the current billing period, at the same price

4.5 Managing Your Subscription

Android: Google Play > Payments & subscriptions > Subscriptions > Palettio

4.6 Refunds

Refund requests are processed by Apple or Google according to their respective policies. We do not process refunds directly.

5. Intellectual Property

5.1 Our Rights

The App — including its source code, design, user interface, graphics, curated color collections, preset palettes, gradient templates, algorithms, and all related documentation — is owned by Palettio and protected by copyright, trademark, and other intellectual property laws worldwide.

5.2 Your Rights

You retain full ownership of colors, palettes, gradients, and any other creative content you produce using the App. We claim no rights over your work.

5.3 Restrictions

You may not:

Copy, reproduce, modify, distribute, sell, license, or create derivative works from the App
Reverse engineer, decompile, disassemble, or attempt to derive the source code
Remove, alter, or obscure proprietary notices, labels, or marks
Use the App to build a competing product or service
Redistribute the App's curated color collections, presets, or templates for commercial purposes
Use automated systems, bots, or scrapers to access the App
Attempt to circumvent subscription restrictions, ad display, or free-tier limitations

6. User Conduct

You agree to use the App only for lawful purposes. You will not use the App in any way that violates applicable laws, infringes the rights of others, or interferes with the App's operation.

7. Advertisements

The free version displays advertisements provided by Google AdMob. By using the free version, you consent to the display of advertisements. Ad content and targeting are determined by Google, subject to your device's tracking preferences. Palettio Pro subscribers see no advertisements.

8. Third-Party Services

The App integrates with third-party services (Google AdMob, RevenueCat, Apple App Store, Google Play Store). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PALETTIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Palettio and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney fees) arising from your use of the App, your violation of these Terms, or your infringement of any rights of a third party.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App ends immediately. Locally stored data remains on your device.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use after changes constitutes acceptance. Material changes will be communicated through the App or this website.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation before pursuing formal proceedings.

15. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Palettio regarding the App, superseding any prior agreements.
